Terms and Conditions

These Terms and Conditions ("Terms") govern all contracts for landscape design, garden construction, installation, garden maintenance and related services (collectively, the "Services") provided by Gardens by George, owned and operated by George Mbappe, trading in England ("we", "us" or "our"), to any customer ("you", "your" or "client").

Please read these Terms carefully. By accepting our quotation, placing an order, paying a deposit or making any payment towards our Services, you agree to be bound by these Terms.

1. Quotations and Acceptance

  • All quotations are valid for 30 days, unless otherwise stated.

  • Quotations are based on the information available at the time of preparing the estimate, including site conditions, project scope and current material costs.

  • Any changes to the agreed specification may require a revised quotation.

  • A contract is formed once you accept our quotation (in writing, by email or electronically) and make the agreed initial payment.

2. Deposits & Instalment Payments

We understand that landscaping projects are a significant investment. For this reason, instalment payment plans are a standard part of how we work, allowing customers to spread the cost of their project.

Initial Deposit

A deposit is required to:

  • Secure your project within our schedule.

  • Begin design work and planning.

  • Order materials and reserve specialist contractors where required.

The deposit amount will be detailed on your quotation or invoice.

Instalment Payments

Most projects are paid through agreed staged instalments rather than a single payment.

Typical payment stages may include:

  • Initial deposit

  • Commencement of works

  • Completion of agreed project milestones

  • Practical completion

Your individual payment schedule will be provided before work begins.

Failure to make scheduled payments may result in delays or suspension of works until payment has been received.

Final Payment

The remaining balance is payable upon practical completion of the agreed works.

Practical completion means the project is substantially complete and ready for use, even if minor snagging items remain.

Late payments may incur interest at 4% above the Bank of England Base Rate, together with any reasonable recovery costs permitted by law.

3. Our Commitment to You

At Gardens by George, our reputation is built on quality workmanship, honesty and reliability.

We are committed to delivering the services, materials and workmanship described within your accepted quotation and project specification.

If any aspect of the completed work does not reasonably match the agreed specification, we will work with you to resolve the issue promptly and fairly.

Customer satisfaction is extremely important to us, and we always aim to complete every project to the highest professional standard.

4. Refund Policy

If, for any reason, we are unable to provide the agreed Services, or we mutually agree that a refund is appropriate, any refund due will be returned to the original payment card or payment method wherever possible.

Refunds will normally be processed within 5–10 working days, depending on your payment provider.

Refunds will not normally apply to:

  • Completed services already delivered.

  • Bespoke materials already ordered specifically for your project.

  • Design work already completed.

  • Costs already incurred on your behalf.

Nothing in this section affects your statutory rights.

5. Bespoke Products & Lead Times

Many of our projects include bespoke products such as pergolas, paving, timber structures, outdoor kitchens, stonework or made-to-order features.

Lead times may vary depending upon manufacturers, suppliers and shipping.

Estimated delivery times are provided in good faith but cannot be guaranteed.

Once bespoke products have been ordered specifically for your project, cancellation charges may apply.

6. Ownership & Intellectual Property

All drawings, designs, plans and associated intellectual property remain the property of Gardens by George until all invoices have been paid in full.

Materials supplied remain our property until payment has been received in full.

Our designs may not be copied, reproduced or supplied to third parties without our written permission.

7. Scope of Works & Variations

Our quotation details the agreed scope of works.

Any additional requests, changes or upgrades requested during the project may result in:

  • Additional costs

  • Revised completion dates

  • Updated quotations

All variations will be discussed and agreed before additional work proceeds.

8. Site Access

You agree to provide:

  • Safe access to the property.

  • Reasonable access to water and electricity where required.

  • Information regarding underground services or known hazards.

We cannot accept responsibility for damage to services or utilities that have not been disclosed or accurately marked.

9. Project Timescales

We always aim to complete projects within the estimated timeframe.

However, completion dates may be affected by:

  • Severe weather

  • Supplier delays

  • Ground conditions

  • Client variations

  • Circumstances beyond our reasonable control

Where delays occur, we will keep you informed throughout the project.

10. Cancellation

You may cancel your project by notifying us in writing.

Where work has already commenced, materials have been ordered or design work completed, reasonable charges may apply.

Deposits covering work already undertaken or bespoke materials may be non-refundable.

11. Warranty

We provide a 12-month workmanship warranty on completed hard landscaping installations from practical completion.

Manufacturer warranties apply to supplied products where available.

Plants and turf are living products and their long-term success depends upon watering, weather conditions and ongoing maintenance. For this reason, we cannot guarantee plant survival after installation.

12. Maintenance

Regular maintenance is essential to preserve the appearance and longevity of your garden.

Gardens by George offers professional maintenance packages throughout the year.

Failure to maintain completed works in accordance with our recommendations may affect warranty claims.

13. Insurance & Liability

We maintain appropriate Public Liability Insurance for all works undertaken.

Except where prohibited by law, our liability shall not exceed the total amount paid by you for the Services.

Nothing within these Terms limits your statutory consumer rights.

14. Privacy

Any personal information collected is used solely for providing our Services and communicating with you.

We do not sell or share your personal information with third parties except where necessary to complete your project or where required by law.

15. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

16. Customer Promise

At Gardens by George, we believe that trust is earned.

We promise to:

  • Deliver the services agreed within your quotation to a professional standard.

  • Keep you informed throughout every stage of your project.

  • Treat your property with respect.

  • Be honest and transparent about pricing and timescales.

  • Resolve any genuine concerns promptly and fairly.

  • Process any agreed refunds back to your original payment method wherever possible.
